1. THE PROMOTER
1.1 The Promoter is Front Runner Australia Pty Ltd (
ABN: 56 640 944 118) of
302/159 Mann St Gosford, New South Wales, Australia.
2. PROMOTION PERIOD
2.1 This is an ongoing monthly promotion. Each monthly promotion period (“Promotion Period”) runs from 12:00am AEST/AEDT on the first day of each calendar month to 11:59pm AEST/AEDT on the last day of that calendar month.
2.2 The Promoter reserves the right to suspend or terminate the promotion at any time by providing reasonable notice on the Website.
3. ELIGIBILITY
3.1 Entry is open to all Australian residents, except:
(a) Directors, officers, management, employees and contractors of the Promoter and its related bodies corporate;
(b) The spouse, de facto partner, parent, child or sibling (whether natural or by marriage) of any person referred to in clause 3.1(a); and
(c) Any person under the age of 18 years. If an entrant is under 18 years of age, their entry will be deemed invalid.
3.2 Entrants must provide valid and truthful personal information as required at the time of entry.
4. HOW TO ENTER
4.1 To enter, eligible persons must, during the relevant Promotion Period:
(a) Purchase a product from the Front Runner product range that includes a promotional swing tag;
(b) Scan the QR code printed on the product swing tag using a compatible smartphone or device; and
(c) Complete the online entry form by providing their full name, email address, and phone number.
4.2 Each unique product purchase entitles the entrant to one (1) entry per Promotion Period. Multiple entries may be submitted in the same Promotion Period provided each entry corresponds to a separate, genuine product purchase.
4.3 Entries are free. No additional purchase beyond the original product purchase is required to enter the promotion.
4.4 Incomplete, ineligible, or fraudulent entries will be deemed invalid. The Promoter reserves the right to verify the validity of all entries and to disqualify any entrant who tampers with the entry process.
5. PRIZE
5.1 There is one (1) prize available per Promotion Period, being a Front Runner Australia online store voucher valued at AUD $2,000.00 (the “Prize”).
5.2 The Prize voucher is redeemable exclusively at https://frontrunnerau.com/ (the “Website”).
5.3 The Prize voucher is valid for a period of three (3) years from the date of issue. Any unused balance after the expiry date will be forfeited and will not be refunded or extended.
5.4 The Prize is not transferable, exchangeable, or redeemable for cash. The Prize cannot be combined with any other offer, voucher, or discount code unless expressly permitted by the Promoter.
5.5 If, for any reason, the Prize (or any part of it) is unavailable, the Promoter reserves the right, in its sole discretion, to substitute the Prize with a prize of equal or greater value, subject to any applicable laws or written directions from any relevant regulatory authority.
6. WINNER SELECTION AND NOTIFICATION
6.1 One (1) winner will be drawn on or about the 1st day of each calendar month for entries received during the immediately preceding Promotion Period.
6.2 The draw will be conducted at 302/159 Mann St Gosford, NSW, Australia, using a computerised random selection process from all valid entries received during the relevant Promotion Period.
6.3 The winner will be notified by email to the email address provided at the time of entry within two (2) business days of the draw.
6.4 If the winner does not respond to the notification within fourteen (14) days of the email being sent, or if the winner is found to be ineligible, the Promoter reserves the right to conduct a redraw under the same conditions. The redraw will take place at the same location and the redrawn winner will be notified within two (2) business days of the redraw.
6.5 The Promoter’s decision in relation to all aspects of the promotion is final, and no correspondence will be entered into.
7. VOUCHER REDEMPTION
7.1 The Prize voucher will be sent to the winner via email in the form of a unique voucher code.
7.2 To redeem the voucher, the winner must enter the voucher code at checkout on the Website.
7.3 The voucher may be used in a single transaction or across multiple transactions until the full value has been redeemed or the voucher has expired, whichever occurs first.
7.4 If the value of the order exceeds the voucher balance, the winner must pay the difference using an accepted payment method.
7.5 Voucher redemption is subject to product availability and the Website’s standard terms and conditions of sale, including shipping and delivery terms.
8. PRIVACY AND PERSONAL INFORMATION
8.1 By entering the promotion, the entrant consents to the collection, use, and disclosure of their personal information by the Promoter for the purposes of administering the promotion, including drawing and notifying the winner.
8.2 The Promoter will handle personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles, and the Promoter’s privacy policy, available on the Website.
8.3 Personal information collected will not be disclosed to third parties except as required for the administration of the promotion or as required by law.
8.4 Entrants may request access to, or correction of, their personal information held by the Promoter by contacting the Promoter at the details set out in clause 15.
9. INTELLECTUAL PROPERTY
9.1 All intellectual property rights in and to the promotion and any materials provided to the winner remain the property of the Promoter.
9.2 Nothing in these Terms and Conditions constitutes a transfer or licence of the Promoter’s intellectual property rights.
10. LIABILITY AND INDEMNITY
10.1 To the maximum extent permitted by law, the Promoter and its related bodies corporate, officers, employees, agents, and contractors are not liable for any loss, damage, or injury suffered or sustained (including but not limited to indirect or consequential loss, or loss arising from negligence) as a result of, or in connection with, entering the promotion or accepting or using the Prize.
10.2 Nothing in these Terms and Conditions limits, excludes, or modifies any consumer guarantee or any other right or remedy that the entrant may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any similar state or territory legislation that cannot be excluded, restricted, or modified.
10.3 The entrant indemnifies and holds the Promoter harmless against any claim, loss, or damage arising out of or in connection with the entrant’s participation in the promotion or breach of these Terms and Conditions.
11. DISQUALIFICATION
11.1 The Promoter reserves the right to disqualify any entrant who:
(a) Provides false, misleading, or fraudulent information;
(b) Tampers with the entry process or the conduct of the promotion;
(c) Engages in any conduct that is contrary to these Terms and Conditions or that may jeopardise the fair and proper conduct of the promotion; or
(d) Acts in a disruptive, threatening, or abusive manner towards the Promoter’s staff.
12. UNCLAIMED PRIZES
12.1 If a Prize remains unclaimed after all reasonable attempts to contact the winner have been made, the Promoter will conduct a redraw in accordance with applicable NSW legislation, including the NSW Fair Trading Regulation.
12.2 The unclaimed Prize redraw will be conducted within three (3) months of the original draw date, at the same location and by the same method. The redrawn winner will be notified within two (2) business days.
13. TAX IMPLICATIONS
13.1 The entrant is responsible for any tax implications arising from winning the Prize. Entrants are advised to seek independent financial advice regarding the tax implications of winning.
14. GENERAL
14.1 These Terms and Conditions are governed by the laws of New South Wales, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of New South Wales.
14.2 If any provision of these Terms and Conditions is held to be invalid, void, unenforceable, or illegal, the remaining provisions shall continue in full force and effect.
14.3 The Promoter’s failure to enforce any provision of these Terms and Conditions does not constitute a waiver of that provision.
14.4 The Promoter reserves the right to amend these Terms and Conditions at any time, subject to any applicable laws. Any amendments will be published on the Website.
14.5 In the event that the promotion cannot proceed as planned due to circumstances beyond the Promoter’s reasonable control (including but not limited to acts of God, pandemic, war, natural disaster, or technical failure), the Promoter reserves the right to cancel, suspend, or modify the promotion, subject to any applicable laws.
14.6 By entering the promotion, the entrant acknowledges that they have read, understood, and agreed to be bound by these Terms and Conditions.

16. APPLICABLE LEGISLATION
16.1 This promotion is conducted in accordance with the laws of New South Wales, Australia, including but not limited to:
(a) The Competition and Consumer Act 2010 (Cth);
(b) The Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010);
(c) The Fair Trading Act 1987 (NSW); and
(d) Any other applicable state or territory legislation governing trade promotions.
16.2 As of 1 July 2019, a trade promotion lottery permit is no longer required in New South Wales. The Promoter is responsible for ensuring compliance with all applicable laws in all states and territories where the promotion is available.
